Terms of service

1. Who can use Proximitii

• You must be at least 13 years old, or 16 in the European Economic Area.
• You must use a valid phone number that belongs to you.
• You may not use Proximitii if you have previously been banned from it.

2. Your account

• You are responsible for what happens on your account. Keep your phone secure: anyone with your device and your text messages can get in.
• Give accurate profile information. Do not impersonate anyone or make an account for someone else.
• One account per person, and no accounts created by automated means.

3. How location sharing works

• Your location is visible only to friends you accepted, never to strangers or the public.
• You control what each friend sees, through per-friend levels, hidden zones, invisible, and pausing location entirely. You can change or revoke any of it at any time.
• Location is approximate and can be delayed, wrong, or missing. Do not rely on Proximitii for emergencies, for navigation, or for any decision where being wrong would matter.

4. Acceptable use

Proximitii exists to get friends into the same room. You agree not to:

• Use it to stalk, harass, threaten, or monitor anyone. Using location features to follow a person without their knowledge and freely given consent is forbidden here and may be a crime where you live.
• Pressure or coerce anyone into sharing their location with you.
• Post anything illegal, hateful, sexually exploitative, or that infringes someone else's rights.
• Try to reach other people's data, probe or disrupt our systems, reverse engineer the app, or work around security or rate limits.
• Use the service for commercial solicitation, spam, or harvesting data.

We may remove content and suspend or end accounts that break these rules, with or without notice. If someone is behaving badly, use the report and block tools in the app or write to support@proximitii.app.

5. Your content

• You own what you make in Proximitii: your photos, your notes, your profile.
• By posting it you give us a limited, non-exclusive, royalty-free licence to host, store, and show that content to the people you shared it with, as far as running the service requires. The licence ends when you delete the content or your account, except where it was shared with others, such as media you added to a shared album, or where short retention is needed for backup integrity or the law.
• You are responsible for what you post, and you must have the right to share it.

6. Privacy

The privacy policy sets out what we collect, including location, what we do with it, and the controls you have, including deleting your location history or your whole account from inside the app. We do not sell your data and we do not use it for advertising.

7. The service

• Proximitii is currently free. We may add optional paid features later. Nothing you already have will quietly start charging you.
• We are always changing the app and may add, alter, or remove features.
• We may suspend or discontinue the service, in whole or in part, with reasonable notice where that is practical.

8. Ending it

• By you: stop using Proximitii whenever you like, and delete your account and everything attached to it in the app under Me › Settings › Delete Account.
• By us: we may suspend or end your access if you break these terms, create risk or legal exposure for us or other people, or if the law requires it.
• The sections that by their nature should outlive the account, including 9 through 11, do.

9. Disclaimers

Proximitii is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, accurate, or error-free, that location will be precise or timely, or that content will never be lost.

10. Limitation of liability

To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, arising from your use of Proximitii, including anything that happens between users or from relying on location information. Our total liability for any claim will not exceed the greater of what you paid us in the twelve months before the claim, currently zero, or fifty US dollars. Some places do not allow these limits, so parts of this section may not apply to you.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages, and expenses, including reasonable legal fees, arising from your content, your use of the service, or your breach of these terms or of someone else's rights.

12. Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law rules. Disputes will be heard in the state or federal courts in Ohio, and you consent to their jurisdiction. Nothing here takes away protections you have under the mandatory consumer-protection laws where you live.

13. Changes to these terms

We may update these terms. When a change matters, we will say so in the app or move the date at the top of this page. Carrying on after that means you accept the new version.
